What If Your Main Goal is Getting Your Medical Bills Paid?
Recently, a client came to Taylor, Warren, Weidner, Hancock & Barnes after spending approximately 18 months trying to resolve a serious slip-and-fall claim on her own. Her injuries were significant and required two surgeries. Yet her primary concern wasn't how much money she could put in her own pocket.
She simply wanted to make sure her medical obligations were taken care of.
The insurance company offered an amount that would cover her Medicare lien. But the client knew TRICARE had also made payments related to her injuries, and she was concerned there could be an additional lien that needed to be resolved.
When she raised the issue with her insurance company, she was essentially told that figuring out the TRICARE lien—and paying it—was her responsibility.
That left her facing a troubling possibility: she could accept the insurance company's offer, satisfy Medicare, and then potentially owe additional money out of her own pocket.
The Insurer's Refusal to Pay All Her Medical Bills Was a Problem
After a year and a half of trying to handle the claim herself, negotiations reached an impasse.

After filing suit and developing the evidence surrounding liability, it became clear that this was a far more substantial case than the insurance company's initial offer reflected—and we're pretty sure the insurance company knew that, as that is very common in our practice.
Ultimately, TWWHB obtained a six-figure settlement for the client while also resolving the Medicare and TRICARE liens.
The difference for our client was substantial.
After her medical reimbursement obligations were addressed, the amount she ultimately received in her own pocket was approximately twice the insurance company's original total offer.

For 18 months, this client wasn't holding out for a windfall. She simply wanted to make sure everyone who needed to be paid was paid—and that she wasn't left personally responsible for medical expenses resulting from an accident that had already required two surgeries.
