Why is my car insurance company paying my medical expenses when the accident wasn't my fault?
ANSWER:
It's a good question, and it has to do with Florida's no-fault system, which says that your insurance pays regardless of fault under your Personal Injury Protection benefits: PIP. Those benefits pay 80% of your medical expenses, 60% of your lost wages, and $5,000 in death benefits. Now these amounts have limitations, and there's all sorts of requirements in filing a claim under your PIP. That doesn't limit your right, necessarily, to go after the at-fault driver for other damages including pain and suffering.
