Trampoline Park Waiver - Personal Injury

TRAMPOLINE PARK WAIVER

In this Legal Minute Video, TWWHB partner, Brian Hancock, will talk about trampoline park injuries and whether a parent or guardian's signing of a liability waiver waives any legal claim for a child's injuries.  The answer is no, and Brian will tell you why as he has assisted numerous clients whose children suffered an injury as a result of a trampoline park's failure to properly operate, maintain, or staff the park.  You can read more of our blogs on trampoline park liability, starting here: https://www.twwlawfirm.com/trampoline-park-injury-caused-by-improperly-trained-staff.

QUESTION

My child was injured at a trampoline park.  I think I signed some documents when we first got to the park that day.  Did I sign away any possibility of having a legal claim for my child's injuries?

ANSWER

No, you did not.  All these trampoline parks, since they first began appearing in 2004, require patrons to sign a liability waiver, and folks often believe that if their child is injured while using the park's attractions that they have no legal recourse whatsoever.  And, that is simply not the case.

There are very strict statutory requirements as to what must be in these waivers.  And, even if the parks follow these statutory requirements, they are still not insulated from their own liability if their negligence, or their failure to properly operate or maintain the park, injures a child.  So, if you or a family member or anyone you know is injured at one of these trampoline parks, don't think for a moment that just because you signed some eight-page waiver that you have no legal rights or recourse.
