Florida E-Bike Safety Bill Vetoed

Posted by Phillip Warren | Jul 10, 2026 | 0 Comments

Electric bicycles have become increasingly popular across Florida, offering an enjoyable and convenient way to travel, exercise, and explore our communities. Unfortunately, the serious accidents involving riders, pedestrians, and motorists that result from this growing popularity have only increased while the rules governing their safe use have decreased.

DeSantis's Veto of SB 382

Recently, Governor Ron DeSantis vetoed Senate Bill 382, a measure that would have introduced several new safety requirements for e-bike riders. Among other provisions, the bill would have required riders to:

·      Slow to 10 mph when pedestrians were nearby

·      Yield to people using shared pathways

·      Give an audible warning before passing; and

·      Establish a statewide system for tracking e-bike crashes.

It also proposed creating a task force to study accident trends and recommend future safety improvements. The Governor cited concerns about expanding government oversight when issuing the veto.

At Taylor, Warren, Weidner, Hancock & Barnes, P.A., our experienced personal injury attorneys understand that reasonable people can disagree about legislation. But one thing should never be controversial: preventing injuries.

Increased E-Bike Injuries

Across Florida and the nation, emergency rooms are treating more people injured in e-bike crashes than ever before. Medical professionals have reported increasing numbers of serious head injuries, facial fractures, and other traumatic injuries, particularly among younger riders. As these bikes become faster and more common, everyone who shares the road or trail has a role to play in keeping one another safe.

What You Can Do to Keep Your Family Safe 🚴‍♀️

Whether or not new laws are enacted, families can take simple steps to reduce the risk of tragedy:

  • Wear a properly fitted helmet every ride.
  • Make sure children understand and follow traffic rules.
  • Slow down around pedestrians and crowded sidewalks.
  • Stay alert and avoid distractions such as cell phones or headphones.
  • Ride predictably and make yourself visible to drivers, especially at intersections.
  • Parents should know what type of e-bike their child is riding and understand its capabilities before allowing them on public roads or shared paths.

Drivers also play an important role. E-bike riders can be more difficult to see than larger vehicles, and their speed is often underestimated. Taking an extra moment to look carefully before turning or opening a vehicle door can help prevent devastating collisions.

As personal injury attorneys, we unfortunately see firsthand how quickly a normal day can change because of a preventable accident. No piece of legislation can replace good judgment, courtesy, and attention to safety.

Bottom Line from TWWLAWFIRM

Whether you're driving, walking, or riding an e-bike this summer, we encourage everyone to slow down, stay aware of your surroundings, and look out for one another. A little extra caution today can prevent a lifetime of hardship tomorrow.
