Frequently Asked Disability Questions:
Q How do I qualify for disability benefits?
A You may qualify for benefits if you are unable to work full time because of a physical or mental condition which will last, or is expected to last, for several months.
Q What if I have other income?
A For recepients of Social Security Disability (”SSDI”), there is no limit to the amount of other income you can receive, so long as it is not from work activity. However, if you are a recipient of Supplemental Security Income (”SSI”) or private disability insurance benefits, there may be an offset.
Q Is there an age requirement for disability?
A No. Any individual of any age can be found to be disabled. However, the older an individual is, the easier it is for that individual to obtain benefits.
Q How long will I receive disability benefits?
A Until you reach full retirement age or until your condition improves to the point where you are able to work on a full-time sustained basis.
Q If I am awarded disability benefits, how much will I receive?
A It varies based on your earnings history. Monthly Social Security Disability Insurance (”SSDI”) benefits can be as high as $2200.00 a month. The amount you receive from private disability insurance is based on a percentage of your pre-disability income.
Q Can my children get benefits if I am disabled?
A Minor children of a disabled worker may receive benefits under the federal program. The amount is approximately 40 percent of the disabled worker’s monthly payment.
Q What can I do to improve my chances of winning a claim for disability benefits?
A Seek legal representation early. Maintain regular and consistent treatment with the doctors that support your claim for disability. If you can’t afford to maintain medical treatment, please contact our office for a list of clinics and county facilities where treatment can be obtained for free or at reduced rates.
Q What will it cost me to hire a disability law firm?
A There is no fee to you for our representation unless we are successful in obtaining your benefits. You will not be responsible for costs unless you recover past due benefits. Our firm can help by reviewing the correspondence from Social Security, so that you can understand how your benefits were determined.
