Probate

Probate is the term used for the court proceeding which passes property from the person who died (the decedent) to those who are supposed to inherit the property.  Probate can occur with or without a Will.  Whether or not probate is necessary depends on the types of assets owned by the decedent.  There are two forms of probate in Florida, formal administration and summary administration.  Formal administration occurs when the total value of the property to be passed is worth more than $75,000.  Summary administration is a simplified process that can be used when the property is worth less than $75,000 or the decedent passed away over two years prior to the filing of a petition for summary administration.
