Gulf Coast Oil Spill: Look Ahead and Prepare

Beach

For those of us on the Gulf who have experienced the aftermath of a hurricane, we know firsthand that it’s better to look ahead and prepare then to look back and regret.  So collectively, we begin preparations for the impact that the oil spill will have on our beautiful beaches, coastal wildlife, and fragile economy. Like so many of you, TWW is hoping for a swift solution to contain the massive spill and minimize its’ destruction to our area.  Whether you live or work on the coast, there are some things you can do to protect your rights and increase your chances of economic recovery should you suffer a loss.

Claims from this disaster will include real and personal property damage, loss of revenue, loss of use, and loss of enjoyment.  These damage claims are expected to affect individuals, associations, and businesses alike.  Victims of the oil spill may include companies and individuals involved in the seafood industry, owners and operators of docks and marinas, private and commercial boat owners, property and restaurant owners, and individuals employed by the tourism and fishing industries.

One of the most important things you can do now is to document your real and personal property.  This includes taking photos and collecting evidence of the value of your property.  It is also vital to document any loss of use, loss of business, or loss of earnings.  This is best accomplished by ensuring that you have complete and accurate records of your previous and current earnings or profits.  Many people on the beach are already reporting lost revenue from the stigma of the spill approaching our shores.

TWW is encouraging everyone to maintain photographic evidence of the property prior to and after the loss, to collect evidence of wages, rental, and business profits prior to and after the loss, and to keep evidence of any expenses incurred as a result of damages.  If you have questions about oil spill damage claims, please call or email our office.  We are committed to providing you the knowledge you need to protect and understand your legal rights in this disaster.
