Condo Associations and Businesses to Pay Higher Premiums

Condo associations and businesses covered by Citizens Property Insurance will be paying higher premiums since Florida’s insurance commissioner approved a 9.9% hike that will affect businesses in high-risk coastal areas.  This increase comes after a 10% hike for homeowners in September.  Other approved increases include, 10.4% increase for fire coverage, an 8% increase for commercial and residential condos and a 11% jump for wind-only insurance for condo associations.

State Insurance Plans Use Surcharges to Control Rates

As reported by Thomas Frank in USA Today, state insurance plans have used bailouts from taxpayers, insurance companies, and policyholders to subsidize premiums for homeowners in hurricane prone areas.  Surcharges can apply to various policies like property, auto, and liability and can add up to 15% to a premium payment.  Citizen’s Insurance in Florida imposed $1 billion in surcharges on every property insurance policy in the state- even on policies it didn’t write.

Stacking v. Non-Stacking UM Insurance Coverage

Hopefully, you already know how important UM coverage is as part of your motor vehicle insurance.  If not, you can read more about it on our previous blog.  One of the things that often confuses people about UM coverage is the difference between stacking UM coverage and non-stacking UM coverage.  Florida law requires insurance companies to offer stacking UM coverage.  This coverage is so important that Florida law also requires that you sign a document rejecting stacking UM coverage if you choose not to purchase it.  When we request a certified copy of an insurance policy for our clients, we also require a copy of the signed written rejection if the insurance company contends that the UM coverage is non-stacking.  The insurance company must provide stacking coverage if they are unable to produce the signed written rejection. Steen’s Family to Seek Civil Suit against City and Officer Ard

Yesterday, State Attorney Bill Eddins announced that he would not pursue criminal charges against Pensacola Police Officer Jerald Ard for his role in the death of 17 year old Victor Steen last October.  This determination followed Escambia County Judge John Simon’s decision Monday that Ard did not bear criminal responsibility for Victor’s death.  The family’s attorneys plan to file a civil lawsuit against the City and Officer Ard now that the coroner’s inquest is complete.  Since coroner’s inquests became mandatory in the 1990′s to investigate officer involved deaths, to date; no officer has ever faced criminal charges upon conclusion of the inquest.
